Los Angeles: investigation into discrimination claim

The Notice of Violation issued by the Los Angeles Civil Rights Department follows an investigation into a discrimination claim made by an African-American shopper against Smart and Final, LLC, and its vendor, Non-Stop Security Services. 

The claimant, identified as Corey Brown, alleges that he was subjected to discriminatory treatment at a Smart and Final store in downtown Los Angeles.

Incident Details

According to officials, Corey Brown visited the Smart and Final store on South Figueroa Street on September 22, 2022. Upon entry, he was instructed by security guards to remove his backpack and leave it at the front before proceeding inside. 

Brown complied with the request but later discovered that customers of different races were allowed to wear backpacks inside the store.

Discriminatory Enforcement

The disparity in treatment prompted Brown to file a complaint with the L.A. Civil Rights Department. The ensuing investigation revealed the implementation of a ‘bag policy’ at the specific Smart and Final location, which was discriminatorily enforced based on customers’ appearances.

Illegal Treatment

At a news conference, Capri Maddox, Executive Director of the L.A. Civil Rights Department, emphasized that Brown’s treatment violated civil rights laws. Maddox reaffirmed that any injustices or inequities in Los Angeles would not be tolerated.

Victim’s Testimony

Brown, speaking at the news conference, expressed his frustration at being discriminated against while simply running an errand. 

He highlighted the unequal treatment he experienced compared to non-African-American patrons, stating that he was targeted because of the color of his skin.

Enforcement Action

Following the investigation, the civil rights department issued a Notice of Violation against Smart and Final Stores, LLC, and Non-Stop Security Services. The action underscores the city’s commitment to upholding civil rights and combating discrimination in all forms.
